BOOKING TERMS

Clear arrangements. Complete discretion.

To ensure every experience is seamless from the first enquiry through to completion, the following booking terms outline the arrangements relating to reservations, payments, cancellations and changes.

By confirming a booking with James Hart, you acknowledge and agree to the terms outlined below.

BOOKING & CONFIRMATION

All bookings are arranged following a private enquiry and confirmation of availability.

Once the details of your experience have been agreed upon, a 50% booking payment is required to secure the requested date and time.

A booking is considered confirmed only once the booking payment has been received and written confirmation has been provided by James Hart.

The remaining balance is payable prior to the commencement of the booking, unless otherwise agreed in writing.

Dates and times cannot be held without payment of the booking amount

PAYMENT

Payment details will be provided privately once a booking request has been accepted.

Payments may be made using the payment methods advised at the time of confirmation.

For discretion and security, clients should use only the payment instructions provided directly by James Hart.

Any applicable transaction or processing fees will be clearly communicated prior to payment.

A receipt or confirmation of payment will be provided upon request.

CANCELLATIONS & RESCHEDULING

Your booking reserves dedicated time exclusively for you. For this reason, the initial 50% booking payment is non-refundable once the booking has been confirmed.

Where sufficient notice is provided, every reasonable effort will be made to accommodate a request to reschedule your booking, subject to availability.

Cancellations made more than 48 hours prior to the scheduled commencement time will result in the booking payment being retained, with no further balance payable.

Cancellations made within 48 hours of the scheduled commencement time, or failure to attend the booking, will require payment of the full agreed booking amount.

Any approved rescheduled booking must be arranged for a mutually agreed date and time and may be subject to changes in availability, rates or associated expenses.

If James Hart is required to cancel a confirmed booking, any amount already paid for services not provided will be refunded in full.

ADDITIONAL TIME & EXPENSES

Each booking is based on the duration, arrangements and requirements agreed upon at the time of confirmation.

Should you wish to extend your booking, additional time may be accommodated subject to availability and will be charged at the applicable rate.

Any extension of time must be mutually agreed upon and is not guaranteed.

Unless expressly included in the agreed booking, additional expenses incurred in connection with an experience — including dining, event tickets, accommodation, transport, parking or other agreed activities — are the responsibility of the client.

Where practical, any anticipated additional expenses will be discussed and agreed upon in advance.

CLIENT CONDUCT & BOUNDARIES

Every James Hart experience is founded on mutual respect, discretion and consideration.

Clients are expected to behave respectfully and appropriately throughout the booking and to respect personal and professional boundaries at all times.

James Hart reserves the right to decline, discontinue or immediately end a booking where conduct is abusive, threatening, discriminatory, unlawful, unsafe or otherwise seriously inappropriate.

A booking may also be ended where agreed boundaries are repeatedly disregarded or where continuing the booking would reasonably compromise the safety or wellbeing of either party.

Where a booking is ended due to serious misconduct or a material breach of these terms by the client, fees already paid may be retained to the extent permitted by law.

Nothing in these terms requires either party to participate in any activity with which they are uncomfortable.

PRIVACY & DISCRETION

Privacy and discretion are fundamental to every James Hart experience.

Personal information and booking details provided by clients will be treated respectfully and confidentially and used only where reasonably necessary to manage enquiries, bookings, payments and the delivery of agreed services.

Client identities, communications and details of an experience will not be publicly disclosed or used for promotional purposes without consent, except where disclosure is required or authorised by law.

Clients are equally expected to respect the privacy of James Hart. Private communications, personal information and other confidential details should not be published, distributed or shared without consent.

Where third-party providers are required as part of an agreed experience, only information reasonably necessary to facilitate those arrangements will be provided.

TRAVEL, ACCOMMODATION & THIRD-PARTY COSTS

Bookings involving travel outside the usual Melbourne service area may incur additional travel time and associated expenses.

Where accommodation, air travel, ground transport or other travel arrangements are reasonably required, these arrangements and associated costs will be discussed and agreed upon prior to confirmation.

Unless otherwise agreed in writing, reasonable travel, accommodation, transport, ticketing and other third-party expenses associated with the booking are the responsibility of the client and are separate from the agreed service fee.

Where James Hart is requested to arrange or purchase tickets, accommodation or other services on behalf of a client, payment for those costs may be required in full before the arrangements are made.

James Hart is not responsible for changes, cancellations, delays or service failures caused by independent third-party providers, subject always to any rights available to the client under applicable law.

BOOKING CHANGES & CLIENT DELAYS

Confirmed booking times are reserved exclusively for the client and commence at the agreed start time.

If a client is delayed or arrives after the agreed commencement time, the booking will ordinarily conclude at the originally agreed finish time.

Where availability permits, additional time may be requested at the applicable rate, but extensions cannot be guaranteed.

Significant changes to the agreed date, time, location or nature of a booking must be discussed and approved in advance and may result in an adjustment to the agreed fee or associated expenses.

James Hart will make every reasonable effort to accommodate reasonable changes where possible.

RESPONSIBILITY & PERSONAL PROPERTY

Clients remain responsible for their personal belongings throughout a booking.

James Hart cannot accept responsibility for personal items that are lost, misplaced, stolen or damaged during an experience, except to the extent that responsibility cannot lawfully be excluded.

Clients are responsible for their own conduct and for complying with the rules, policies and requirements of any venue, accommodation provider, transport provider or other third party involved in an experience.

Any loss or damage caused by a client to property, accommodation, vehicles, venues or other third-party property may remain the responsibility of the client.

James Hart will always take reasonable care in the delivery of agreed services and nothing in these Booking Terms is intended to exclude or limit any rights or remedies that cannot lawfully be excluded.

ACCEPTANCE OF TERMS

By confirming a booking and making the required booking payment, the client acknowledges that they have read, understood and agreed to these Booking Terms.

These terms form part of the agreement between the client and James Hart in relation to the confirmed booking.

Any variation to these terms or to the agreed booking arrangements must be confirmed in writing.

If any provision of these Booking Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Nothing in these Booking Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
